MARSHFIELD — Former Select Board Member Stephen Darcy, who did not run for re-election after his term expired this month, avoided trial on two drunk driving charges after the court granted him a continuance without a finding. Darcy is now under probation, and the case will be dismissed without a conviction if he meets all the conditions of his probation until May 4, 2027, according to Plymouth District Court documents.
Darcy admitted to facts sufficient for a conviction on charges of operating a motor vehicle under the influence of alcohol and negligent operation of a motor vehicle, allowing the court to place him on probation without a criminal conviction on his record.
Plymouth District Court Judge Shelby Smith ordered Darcy to enroll in a driver alcohol education program administered by the department of public health, in accordance with Massachusetts general law c.90 § 24D. His license is also suspended for 45 days, and he owes $300 in assessments.
The 24D disposition law allows for probation with those conditions without a guilty verdict for first-time offenders who did not cause serious injury to another person.
Darcy was arrested in Duxbury April 3 of last year, when police allege that he tested with a blood-alcohol level of .25% after operating his vehicle. The legal limit is .08%. He was released from custody on his own recognizance, and his trial was originally scheduled for March 5, but was postponed twice prior to this admission.
