A 46-year-old Carver man is facing a hate crime charge after police say he attacked a Black man at a Kingston gas station while repeatedly yelling racial slurs.
Kingston police responded shortly after 7:30 a.m. Sept. 8 to the Cumberland Farms at 41 Main St. for a report of a fight in progress. Police said the victim told officers he had been at the gas pumps when a stranger began yelling racial slurs at him without provocation.
Police identified the man as Gary Phillipo II, 46, of Carver.
According to police, Phillipo then charged at the victim and a fight followed. Police allege Phillipo kicked the man, struck him several times and knocked him to the ground before the victim fought back.
The victim suffered several injuries, including what police described as a suspected compound fracture.
Investigators determined Phillipo was the primary aggressor, police said. Witnesses at the scene provided statements that appeared to corroborate the victim’s account and described Phillipo as acting irate and out of control.
Police said Phillipo continued yelling racial slurs and acting erratically after officers arrived. Officer Oxsen arrested Phillipo and transported him to the police station.
Phillipo later complained of an injury and was taken to a hospital, according to police. While at the emergency department, police allege he continued yelling profanities and racial slurs at officers and hospital staff and made sexualized comments.
In the days after the incident, Oxsen obtained surveillance video from Cumberland Farms that police said appeared to further corroborate the victim’s account that the attack was unprovoked.
Phillipo was charged with assault and battery with a dangerous weapon causing serious bodily injury, assault and battery to intimidate resulting in bodily injury, which police identified as a hate crime charge, and disturbing the peace.
Phillipo remained in custody following his arraignment and is scheduled to return to court next month, according to police.
